AUSTIN, Texas – An appellate court in Texas has ruled that a state judge has jurisdiction over a divorce in the state and that it does not violate federal court rules when the judge issues marriage licenses.
The 7th US Circuit Court of Appeals said that the marriage licenses issued by Texas District Judge David Boies to the wife of Elton John in 2012 were valid and that he did not violate the Uniform Florida Statutes.
Boos issued a marriage license to John and the wife, Carla, in 2011.
The couple filed for divorce in 2013 and they filed for an annulment in August.
They also filed a complaint for a temporary restraining order.
Boo denied their petition for divorce, saying he would have a “reasonable” time to process the matter.
Bos has said he could have issued the licenses within six months if he wanted to, but he said he did have a family emergency and couldn’t take the time.
A federal judge ruled in December that the couple could file for divorce and the judge has not heard the case since.
